Action in the Stearns County District Court for personal injuries allegedly sustained by plaintiff, Leona Krips, as a passenger in an automobile driven by defendant Mercida Krips which collided with certain hogs owned by defendant Edward Sobota. The case was tried before E. J. Ruegemer, Judge, and a jury, which returned a verdict for plaintiff for $8,022.31 against defendant Krips only. Thereafter, plaintiff having died, Oswald Botz, administrator c.t.a. of her estate, was substituted in her place. Defendant Krips appealed from an order denying her alternative motion for judgment notwithstanding the verdict or for a new trial.
